I feel that the review/rating provided by a user is incorrect/defamatory and I want it removed. What should I do to have it removed?

If you feel that the review/rating provided by a user is incorrect/defamatory, please click on the “Flag Review” icon provided in the section. Also, please provide us with a suitable explanation why you feel that the review/rating should be removed. We will review the flagged comments. If the review/rating is approved, then that particular comment cannot be reflagged.

I am not happy with a review/rating by a user. I feel it is unfair and in a bad light. I want it removed from my profile. What steps do I take to have it removed?

If you feel that the review/rating provided by a user is unfair and in a bad light, please click on the “Flag Review” icon provided near the review/rating. Also, please provide us with a suitable explanation why you feel that the review/rating should be removed. We will review the flagged comments. If the review/rating is approved, then that particular comment cannot be reflagged.

I find that some reviews/ratings are removed from my profile. How did this happen?

We have installed spam filters that automatically notify us of multiple user ratings from the same user account or the same computer system. In such cases, some of the reviews/ratings may be removed from the profile.

On my profile, I do not accept some of the user reviews/ratings, since I deem it mala fide. What steps do I take to have it removed from my profile?

The user review/rating of physicians is deemed to be provided by genuine users based on their truthful experiences. Hence, we are not in a position to remove them. DoveMed allows the users to rate and review doctors that they have experienced or interacted with. According to DoveMed terms of usage, patients are encouraged to share only their genuine physician experiences. If the review/rating provided by a user is unacceptable to you, please click on the “Flag Review” icon provided near the review/rating. If you further feel that you need to take this forward, since the review is indeed mala fide, you may check with your lawyer on the legal recourse that you may have. Please note that DoveMed is not a ‘publisher or speaker’ of rating/reviews; we merely provide a platform for users to share their experiences.

My business is being affected by some of the user reviews and/or ratings on your website since it is incorrect. I do not appreciate you displaying them on my profile. What recourse to action do I have to get this issue addressed?

It is not the intention of DoveMed to harm any business. We merely provide a platform for users to report their experiences. If the review/rating provided by a user is unacceptable to you, please click on the “Flag Review” icon provided near the review/rating. Nevertheless, DoveMed allows you to post one response to the user review. We request you to post your response suitably against the review that you find unacceptable.

I had notified you earlier that some of the user reviews and/or ratings on your website are unacceptable to me. Further to that, you have not responded accordingly. I have no option now, but to pursue the matter legally against you.

We sincerely apologize for inconveniencing you in this regard. However, we wish to inform you that as per the Communications Decency Act (CDA) of the government, we are not the "publisher or speaker" of the reviews/ratings provided by our users. Moreover, thus, we are not liable for any defamation or legal penalty whatsoever. Communications Decency Act (CDA): "No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider." 47 U.S.C. § 230.

Since you have modified the language of the user review and/or used the specific user rating to collectively provide me with an aggregate rating; I do not think that the CDA immunity is valid in this case anymore.

Even though there is some modification to the user provided review/rating, the CDA is still valid, as is amply demonstrated in numerous court cases. Under section 230(c)(2)(A), "No provider or user of an interactive computer service shall be held liable on account of (A) any action voluntarily taken in good faith to restrict access to or availability of material that the provider or user considers being obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable, whether or not such material is constitutionally protected."

Since, the reviews provided on my profile page, on your website are defamatory in nature; I wish to send you a legal (show cause) notice holding you responsible for your actions and liable to be sued in a court of law.

In such a case, we take recourse to CDA, which gives us complete legal immunity for the ‘user’ expressed statements displayed on our website.

Despite everything, I feel I have been wronged and wish to pursue the matters legally. I feel in the best interest of both the parties; it would be better if you could just remove the user review/rating forthwith.

We request you to please educate yourself on the anti-SLAPP law (SLAPP - Strategic Lawsuit Against Public Participation), which has been passed by several States. The courts may expeditiously review such cases and dismiss these claims. This may lead to counterclaims to compensate for damages to address the above frivolous lawsuits.

I am outside the jurisdiction of USA, and I feel I can take up the mala fide user review/rating matter in a local court here.

You may file a case and probably win a judgment outside of the USA. However, it is not possible to enforce the same within the US, since there are strict laws protecting US-based organizations from lawsuits based in a foreign land.

What is the process for sending a subpoena? Where do I send it to?

If you plan to send a subpoena, please get in touch with your lawyer for the legal formalities. You may send subpoenas and all other legal letters to the address given below:

I wish to know the patients who review my service or rate me. Why do you maintain user anonymity on this?

Under the First Amendment to the Constitution, the US Supreme Court guarantees the anonymity of speech on various platforms including on any web-based service (or internet).

How does the DoveScore work?

A community with a higher score means that the community is close to quality health care. For each area, communities receive points based on their distance to the amenities in each category. Then, the data is summed and normalized to give a score between 1 and 100. A decay function is used to provide more points to areas closer to facilities and fewer points to areas farther from facilities.

What can I use a DoveScore for?

A DoveScore Rating can be the start of a journey of understanding a place, specifically from the perspective of healthcare. For instance, you may be involved in a decision about a place to live. Thinking about the different DoveScore Ratings for a place might attract your attention to potentially desirable or undesirable aspects of living there – they may cause you to want to learn more.

How many areas does the DoveScore serve?

Why are there so many different DoveScores, and what does each one mean?

Each of us has different healthcare needs, and so when we set out to understand availability and accessibility of healthcare in a place, we may care about different things. The full set of DoveScores provides many different ways of looking at healthcare. For example, if you have young children and need to consider pediatric services, you could look at the Kid Score measure for a place. You may also want to understand the overall availability and accessibility of healthcare. You can learn more about each DoveScore Rating here.

I see/visit a certain physician in my area. However, somehow I am not able to locate his/her profile page on your website. What do I do now?

There may be several reasons for this. DoveMed uses a database of physicians currently practicing in the United States. Your physician’s practice may be new and not added to the database yet. DoveMed tries to update the profiles frequently. It may also be possible that your physician is no longer practicing, may be retired, or decreased. In some cases, if we deem that the comments are made using foul language, are irrelevant to the subject, or extremely hurtful and insensitive, we reserve the right to hold them back and not publish them on DoveMed.

Do you have any guidelines for providing comments or rating a physician?

We request you to provide truthful information based on your personal experiences at the physician’s clinic or office, within the survey layout provided. We request you to provide physician review/ratings as early as you can (within 30 days of seeing the provider), following your visit to the physician.

Can I edit my reviews? Can I add more information to the same? Should I be logged into my use account for doing so?

You may add more (or new) information to a previously provided review, although once published, you cannot edit the review. You can always add a new review. However, you can always delete the review comments and write a new one. Yes, you should be logged in to your account for adding new information.

How can a patient leave a great review?

Regardless if your experience were positive or negative, your reviews would be useful for future patients and physicians if you follow these guidelines. Stay friendly, courteous, and constructive. Your reviews can be taken well when you stay constructive and stick to the visit. Be detailed and specific. Do not give personal information, but try your best to be specific. If the physician is mean, specify how the physician was mean. Did the physician cut you off several times when you were explaining your symptoms? Did the physician ignore your concerns? If the physician was nice, how was the physician nice? Did the physician look attentive? Did the physician explain your problem? Try to be as detailed as possible without revealing personal information. Keep it honest. You can only help patients and physicians if you are honest. Physicians read their reviews, and many want to improve. If your review feels dishonest, then they will not listen to any of your concerns. Make sure

Why do DoveMed moderate reviews so carefully?

DoveMed wants to make sure that patients receive the best healthcare possible. We moderate reviews to ensure that reviews are reputable, relevant, and representative of the patient and the physician. Unfortunately, some individuals attempt to publish falsified, harmful, and spammy material that could tarnish the reputation of physicians and deplete the experience of a patient.

Are my review and ratings immediately posted or displayed on the webpage? Do you edit/modify my physician reviews and ratings?

Your review and ratings are not displayed immediately on the webpage. DoveMed will edit, modify, or even remove a user review as it deems appropriate.

Is there a limit to the number of times I can provide physician reviews? Can I provide reviews for multiple physicians?

You can review/rate a doctor once every 30 days, based on your interaction with them. We request you to provide genuine reviews based on your individual experiences following your recent visit or interaction with them. Yes, you may review multiple physicians based on your interactions with them. However, we have automated spam filters that do not permit multiple ratings for the same doctor from the same account or same computer system.

Is there a possibility that I may be sued for providing a ‘bad’ physician review? How protected am I in this?

We request you to be truthful and accurate in your reviews. Please understand that the onus is on the user and his/her review of a physician(s). DoveMed offers a platform for sharing user experience that is beneficial to both the patient and the doctor. It is not in our interest to hurt a business or malign a physician. In case of a poor review that has offended a physician, please be informed that DoveMed is not culpable of any offence, and thus not liable for any legal proceedings. However, if there is a perceived mala fide intention on the part of the user, then it is up to the user to protect himself/herself suitably.
